BUKAAH Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BUKAAH website, mobile applications, SMS services, and related services (collectively, the "Platform"). By accessing or using BUKAAH, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. ABOUT BUKAAH

BUKAAH is a technology platform that connects customers with local grocery merchants and food vendors through meal discovery, ordering, pickup, and delivery services. BUKAAH is not a grocery store, does not prepare food, and does not own or operate delivery services. Merchants fulfill orders, and third-party providers (such as DoorDash) may handle delivery.

2. ELIGIBILITY

You must be at least 18 years old to use the Platform. By using BUKAAH, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. ACCOUNT REGISTRATION

To place orders or access certain features, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use

You are responsible for all activity that occurs under your account.

4. SMS PROGRAM TERMS (BUKAAH SMS Notifications Program)

By providing your phone number and opting in, you agree to receive SMS messages from BUKAAH.

Program Description:

The BUKAAH SMS Notifications Program provides transactional and service-related messages, including but not limited to:

  • Account verification codes
  • Order confirmations
  • Order status updates
  • Pickup and delivery notifications
  • Account-related alerts

Marketing messages may be sent only if you have separately opted in.

Message Frequency:

Message frequency may vary depending on your activity on the Platform (for example, number of orders placed).

Message & Data Rates:

Message and data rates may apply. Charges depend on your mobile carrier plan.

Opt-Out Instructions:

You may opt out of SMS communications at any time by replying STOP to any BUKAAH message.

After sending STOP, you will receive one final confirmation message and will no longer receive SMS messages from BUKAAH unless you opt back in.

Carriers are not liable for delayed or undelivered messages.

Consent:

Your consent to receive SMS messages is not a condition of purchase. SMS consent is collected through an explicit opt-in checkbox and is not pre-selected.

5. ORDERS & PAYMENTS

5.1 Order Placement

When you place an order on BUKAAH, you are making an offer to purchase products from a participating merchant. Orders are subject to merchant confirmation.

5.2 Payment Authorization & Capture

At checkout, BUKAAH may place a temporary authorization hold on your payment method. Your payment will be captured only after the merchant confirms availability of your order. If a merchant does not confirm within a reasonable time, the order may be canceled and the authorization released.

5.3 Pricing

  • Prices shown on BUKAAH may differ from in-store prices.
  • Prices displayed in the app are the final prices charged.
  • Delivery fees, service fees, and applicable taxes are shown at checkout.

5.4 Taxes

Sales tax may apply to certain items depending on applicable law. Where required, BUKAAH collects and remits sales tax as a marketplace facilitator.

6. DELIVERY & PICKUP

6.1 Delivery

Delivery services may be fulfilled by third-party providers. Delivery times are estimates only and are not guaranteed.

6.2 Pickup

For pickup orders, you are responsible for arriving at the merchant location during designated pickup times. BUKAAH is not responsible for delays or issues that occur after the order is made available for pickup.

7. SUBSTITUTIONS & AVAILABILITY

Merchants may substitute unavailable items with comparable alternatives when appropriate. You acknowledge that:

  • Product availability may vary
  • Exact brands or packaging may not always be available
  • Substitutions may be offered or automatically applied based on your preferences

8. CANCELLATIONS & REFUNDS

8.1 Cancellations

Orders may be canceled if:

  • The merchant does not confirm availability
  • Items are unavailable
  • Fraud or misuse is suspected

8.2 Refunds

Refunds, if applicable, will be issued to the original payment method. Delivery and service fees may be non-refundable unless required by law.

9. MERCHANTS & THIRD-PARTY SERVICES

BUKAAH does not guarantee the quality, safety, or legality of products sold by merchants. Merchants are solely responsible for:

  • Product descriptions
  • Pricing accuracy
  • Food safety and compliance

Third-party services (including payment processors and delivery providers) are governed by their own terms and policies.

10. USER CONDUCT

You agree not to:

  • Use the Platform for unlawful purposes
  • Interfere with the operation or security of the Platform
  • Provide false information or impersonate others
  • Abuse merchants, delivery partners, or customer support

BUKAAH reserves the right to suspend or terminate accounts for violations of these Terms.

11. INTELLECTUAL PROPERTY

All content on the Platform, including text, graphics, logos, and software, is owned by or licensed to BUKAAH and protected by intellectual property laws. You may not use, copy, or distribute content without prior written permission.

12. DISCLAIMER OF WARRANTIES

The Platform is provided "AS IS" and "AS AVAILABLE." BUKAAH disclaims all warranties, express or implied.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, BUKAAH shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Platform.

14. INDEMNIFICATION

You agree to indemnify and hold harmless BUKAAH and its affiliates from any claims arising from your use of the Platform.

15. GOVERNING LAW

These Terms are governed by the laws of the State of California.

16. CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
